LABOR RELATIONS
The Labor Relations practice is national in scope, and our attorneys have extensive experience in handling labor relations matters. We assist employers in all stages of the labor relations process, including:
Management training in strategies for obtaining or maintaining a union-free environment.
Development and management of campaigns to defeat union organizing drives, including National Labor Relations Board (“NLRB”) certification elections.
Development and management of campaigns to decertify unions in NLRB decertification elections.
Unfair labor practice charges before the NLRB.
Collective bargaining negotiations, including drafting agreements.
Representation of employers in grievance and arbitration matters arising under collective bargaining agreements.
Suits for injunctions against unlawful picketing and other strike activity.
Sample Representations
Opposed unions in the NLRB election process in diverse industries, including health care, transportation, publishing, manufacturing, and property management.
Won NLRB certification election campaigns for management at large, privately-held manufacturing facilities in Virginia and Maryland. Representation included development of campaign strategies and communications, counseling management in campaign activities, and defending against union unfair labor practice charges.
Developed and effected collective bargaining strategy for trucking company after union was certified as employees’ bargaining agent. Bargaining stretched over one-year period, and ultimately employees petitioned for and won decertification of the union, which returned the company to union-free status.
Removed entrenched union as employees’ bargaining agent at retirement community/nursing home through NLRB decertification election. Effort included defeat of union attempt to block election and development and management of campaign to convince 138-person unit to remove union.
Regularly train all levels of management in obtaining or maintaining a union-free environment. Training program includes instruction on detecting union organizing activity and proper responses, general themes in counter-union campaigns, proactive steps to avoid union organizing altogether.
