A Report from the Tariff Trenches: A Jigsaw in a Wind Tunnel

Tuesday, September 23rd | 12 PM ET

Gain a foothold in today’s shifting tariff. We’ll begin the essentials: where tariff levels stand now (and how importers/exporters are adapting), the state of legal challenges to “reciprocal” tariffs, smart shifts in pricing and valuation strategies, and how to stay out of CBP’s crosshairs amid heightened enforcement on alleged evasion (think transshipment). Plus, we’ll break down the August 29 Federal Circuit of Appeals decision affirming the CIT’s ruling that IEEPA “reciprocal” tariffs are unlawful—what it means today, what could change if the Supreme Court affirms, and how companies might position for potential duty refunds already paid.

We’ll also dig into contracting issues and terms to sharpen who bears tariff obligations—or how they’re shared—including price-adjustment mechanisms, responsibility for duties, Incoterms alignment, origin/content representations, cooperation/audit provisions, and refund pass-through language.

And because it’s shaping real costs now, we’ll cover the ongoing applicability of Section 232 steel and aluminum rates and a practical, step-by-step on calculating steel/aluminum content to determine exposure—where our team has deep expertise and proven methods.

Who Should Attend:

  • Importers — Any company bringing goods into the U.S., including raw materials, manufacturing components, pharmaceutical products, and consumer goods.

  • Service partners to importers — Customs house brokers, port operators, and other attorneys who advise importers.
